Thank you for shopping with Hertes. By purchasing coffee products through our website, mobile application, or physical stores, you agree to be bound by these Terms and Conditions (“Terms”). Please read them carefully.

Scope & Acceptance

These Terms govern your purchase of coffee products from Hertes (including the Cloffy brand). By placing an order, you confirm that you have read, understood, and agree to these Terms.

Changes to These Terms

We may modify or update these Terms at any time. Changes are effective when posted on our website, and the “Effective Date” above will be updated accordingly.

Eligibility

To place an order, you must be at least 18 years old or have the permission of a parent or legal guardian.

Products & Availability

All coffee products are subject to availability. We strive to keep inventory up to date, but we cannot guarantee that every product listed online or in-store is in stock. If an item is out of stock, we will notify you and you may choose a refund, a substitute, or to wait for restock.

Ordering & Acceptance

By placing an order through our website, mobile app, or in-store, you make an offer to purchase products. You will receive an order confirmation email; however, this does not constitute acceptance. We reserve the right to cancel or refuse any order at our discretion. If we cancel an order after payment, we will refund the full amount paid.

Pricing & Payment

Prices are listed in Indian Rupees (INR) and may be inclusive or exclusive of taxes, as stated at checkout. Prices are subject to change without prior notice. If a pricing error occurs, we will inform you and offer the option to cancel or proceed at the corrected price. Accepted payment methods include credit card, debit card, and UPI. Payment must be received in full before processing and shipping your order.

Discounts & Promotions

Discounts, offers, and promotional codes may be subject to specific terms and may not be combined unless explicitly stated.

Shipping & Delivery

We offer shipping within India via selected carriers. Shipping costs are calculated at checkout based on destination and method. Delivery times are estimates and can vary by location and carrier. We are not responsible for delays caused by carriers, customs, or factors beyond our control.

Risk of Loss

Risk of loss or damage passes to you when the product is delivered to the carrier.

Address Accuracy

We are not responsible for failed deliveries due to incorrect or incomplete addresses. Please verify your shipping details before submitting the order.

Returns & Refunds (Perishables)

We do not accept returns or exchanges for perishable items, including coffee products, unless the item is defective or damaged on arrival. If you receive a damaged or defective product, please contact us promptly (preferably within 48 hours) with your order ID and photos so we can arrange a replacement or refund. Refunds (if applicable) are issued to the original payment method within 5–7 days. Shipping fees are non-refundable unless the product was damaged or defective. Subscriptions

If you enroll in a subscription, it will automatically renew at the selected frequency (e.g., weekly or monthly). You may cancel anytime via your account or by contacting customer support. Cancellations must occur before the next billing date to avoid charges. We may change subscription pricing or terms with prior notice.

Use & Resale

Our products are intended for personal consumption and not for resale unless expressly authorized in writing by Hertes.

Health & Allergens

We are not responsible for allergic reactions or health issues arising from consumption of our products. Please review ingredients carefully and consult a healthcare provider if you have concerns.

Intellectual Property

All content, images, product descriptions, and trademarks on our website, app, and packaging are the property of Hertes Food Products Private Limited or are used under license. Third-party assets (e.g., from Freepik or Canva) remain the property of their respective owners and are used in accordance with their licenses. You may not use, reproduce, or distribute our intellectual property without prior written consent.

Limitation of Liability

To the maximum extent permitted by law, Hertes shall not be liable for any indirect, incidental, special, or consequential damages arising from the purchase or use of our products, including without limitation loss of profits, data, or business. Our total liability for any claim shall not exceed the amount paid for the product giving rise to the claim.

Governing Law & Jurisdiction

These Terms are governed by the laws of India. Any disputes shall be resolved exclusively in the courts of India.
